Legal Expert: The PM has the right to reshuffle his Cabinet

The Legal Expert, Counselor Salem Hawas, affirmed, “The text of Article 78 of the Iraqi constitution stipulates that the Prime Minister is the direct executive responsible for the general policy of the state, and the Commander-in-Chief of the Armed Forces. He manages the Council of Ministers, presides over its meetings, and has the right to dismiss ministers, with the approval of the House of Representatives.

Hawass added in a statement, “The determination of the Prime Minister, Muhammad al-Sudani, to carry out the Cabinet change at the appropriate time, is contingent on the approval of the House of Representatives when he goes to parliament and requests the dismissal of the negligent Minister. Therefore, whoever wants to refuse will be responsible before the people historically and politically.”

He continued, “It is true that the constitution’s provisions are absolute, and the absolute is based on its release, but the problem that will face it is the political forces and parties that are still adhering to quotas, and therefore there is no harm or objection to that minister, Undersecretary, or Director General of the same component and bloc being replaced, but with another better professional so that it is not a political targeting or sectarian on the one hand, and as long as there are no red lines on the issue of combating corruption on the other hand.
